Pinoy Nanny Files Charges Against A-List Hollywood Actress
Mar 18, 2013
A famous Hollywood actress is set to appear in court to face harassment and unfair termination charges filed by a Filipina who used to work for her as a live-in nanny.
In May 2012, the overseas Filipino worker (OFW), Erlina Elemen filed a complaint against Sharon Stone for the alleged racist abuse and unlawful termination. Elemen started working for Stone in 2006. In 2008, she was promoted to be a head live-in nanny but was illegally dismissed in February 2011. According to Elemen, she received insults from Stone because of her Filipino heritage and then fired from work when the actress discovered that she received wages for working during holidays and family vacations.
The case filed by Elemen was welcomed by Mary Strobel, the Judge of Los Angeles Superior Court because the evidence provided by the lawyers is enough to support the allegations of harassment, failure to prevent harassment, retaliation and wrongful termination. The trial for the said case is scheduled in July 30.
Elemen’s lawyer, Solomon Gresen said “We’re pleased the judge recognized that the plaintiff’s claims should proceed.”
Meanwhile, the lawyers representing Stone previously tried to have the case dismissed by saying that the comments made by the actress cannot be considered harassment.
Daniel Gutenplan, lawyer of Stone said, “All we have is that Ms Stone made comments about Filipino food, Filipino accents.”
When the news of Elemen’s filing of a legal case came out in May last year, the publicists of Stone called the action “absurd” and implied that the Filipino is only after the actress’s money.
However, the complainant narrated that Stone likened being Filipino with being stupid and that the actress doesn’t want her children to talk like Elemen so the nanny is prohibited from speaking in front of her children. She is also not allowed to read the Bible in Stone’s home.
The 17-page lawsuit states that the actress owes Elemen an unspecified amount for unpaid wages, damages and penalties, and is seeking a trial by jury.
