OFWs in Qatar: Can You Avail End-of-Service Benefits?

Like in Saudi Arabia, overseas Filipino workers in Qatar are also entitled to the end-of-service benefits (EOS) or gratuity. The Qatari government’s labour law strictly imposes the rights of employees which includes the entitlement to be paid to the EOS
OFWs in Qatar are entitled to EOS if they have completed at least one year of continuous service to their employer when their contract is terminated.
But if an OFW is terminated because of gross misconduct and other unlawful deeds, he is not qualifying for EOS. OFWs that terminated contract because he was assaulted by employer should be paid EOS in addition to their employment termination payments.
Both the OFW and his employer in Qatar can agree on the amount of EOS to be paid upon termination. But the EOS should be equal to at least three weeks’ pay of the employee’s final basic salary for every year he had worked for the employer. The basic salary on the date of termination of OFWs will be the basis for the calculation of EOS. Valid leave like sick leave and annual leave are included in the calculations of end-of-service benefits.
For example, an OFW worked for his employer for less than 5 years, the computation will be 3 weeks for every year the OFW worked.
Formula: Basic Salary / 30 (the number of days in a month) x 21 days (three weeks) = 1 yr Gratuity
Example: Basic Salary is 3000 QR
3000 QR / 30 days = 100 QR
100 QR x 21 days = 2,100 QR
2,100 QR x 3 years = 6,300 QR
Now, if the OFW worked for more than 5 years but less than 10 years, it will be 4 weeks.
Example: basic salary is 3000 QR
3000 / 30 days = 100 QR
100 QR x 28 days = 2,800 QR
2,800 QR x 8 years = 22,400 QR
But if the OFW rendered service to his employer for more than 10 years, his EOS will be computed for 5 weeks.
Example: basic salary is 3000 QR
3000 / 30 days = 100 QR
100 QR x 35 days = 3,500 QR
3,500 QR x 15 years = 52,500 QR
If, however, an OFW owes some money to his employer, it is to be deducted from the service gratuity to be given.
The end-of-service benefits or gratuity should be given to OFWs by their employer in Qatar upon termination of their contract or employment. But other employers chose to give it annually as it is easier for them than giving it one lump sum.
